- ERRORS OR OMISSIONS IN ANY CONTENT OR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SITE.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA LUCE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
The limitations of liability set forth in this Section reflect a fair allocation of risk between you and Pizza Luce and are a fundamental element of the basis of the bargain between you and Pizza Luce. These limitations shall apply even if Pizza Luce has been advised of the possibility of such damages.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Luce and its owners, officers, directors, employees, agents, contractors, partners, suppliers, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including, but not limited to, attorney's fees and court costs) arising out of or related to:

Except as set forth below, you and Pizza Luce agree that any dispute, controversy, or claim arising out of or related to these Terms, any breach thereof, or your use of our services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall take place in Minnesota, United States, and shall be conducted in the English language. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
12.3 Class Action Waiver
YOU AND PIZZA LUCE EXPRESSLY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION. Unless both parties agree in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.
12.4 Exceptions to Arbitration
Notwithstanding the arbitration agreement above, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidential information, or other proprietary rights.
12.5 Opt-Out Right
You have the right to opt out of binding arbitration by sending written notice of your decision to opt out to [email protected] within thirty (30) days of first becoming subject to this arbitration agreement. Your notice must include your name, mailing address, and a clear statement that you want to opt out of this arbitration agreement.
